Terms of service

1. Who we are

Gecko Technology Inc, a Colorado corporation with its registered office at 1125 17th Street, Denver, CO 80202, USA, operates geckotechnology.cc and provides cloud infrastructure, GPU compute, AI gateway access and paid-growth services.

2. Orders and acceptance

Submitting an order or trial request is an offer to purchase. A contract forms when we confirm the order in writing and, for paid services, when payment clears. We may decline orders that we cannot safely or lawfully fulfil.

3. Pricing and billing

All prices are in US dollars and exclude applicable taxes. Monthly plans renew automatically until cancelled. GPU instances are billed per day. Prepaid AI credit is consumed by API usage and is non-refundable once used. Invoices are payable by card or wire transfer.

4. Acceptable use

You may not use the services for unlawful activity, unsolicited bulk messaging, malware, phishing, illegal gambling, child exploitation material, or to attack third-party systems. We may suspend services immediately where continued operation creates a legal, security or abuse risk.

5. Customer content and data

You retain ownership of data you store or transmit. You are responsible for having the rights to that data and for your own backups where required. We process data as described in our privacy policy and, on request, under a data processing agreement.

6. Service levels

Availability and support commitments are set out in the Service Level Agreement. Service credits are the exclusive remedy for missed availability targets.

7. Suspension and termination

You may cancel at any time before the next billing cycle. We may terminate for material breach, non-payment or prohibited use. On termination we make data available for export for 14 days, after which it may be deleted.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising from the services is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect or consequential loss, including lost profits or data.

9. Governing law

These terms are governed by the laws of the State of Colorado, United States. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in Denver County, Colorado.
